What is a living will?
A living will is a document which provides instructions to the medical professions taking care of you about your wishes if you are incapacitated and no longer able to give directions of your own accord. For example, you may provide instructions that should you suffer from a particular medical condition, that you do not wish to be resuscitated or kept on life support.
A living will is often referred to as an “advance directive”. The document enables you to put your wishes concerning medical treatment in writing and state which treatments you would want to be carried out, or not to be carried out if a time should come where you are unable to communicate your preferences.
Is a living will legally binding?
There is no legal precedent in Scotland that makes an advance directive for refusal of treatment legally binding. However, it is generally accepted that if an advance directive is created when the granter had the capacity to do so and that the granter sufficiently understood the consequences, purpose and effect of the proposed treatment and refusal, the advance directive will be binding.
